GARD, thanks very much.   I was wondering the same thing and starting to get ticked off over this exact thing.  

How difficult is it to look at the other thread, read about this, and figure out what department.

For what it is worth. 

I just read my own City Code of Ordinance and according to it, Animal Control, which is part of the Police Department is permitted to ingress and egress from private property without owner's permission.  

My assumption is that there is an Ordinance in place in the County where Max lived that regulates matters. 

For me, our Ordinance was very enlightening:

On tethered animals on private property: "It shall be unlawful to tie or tether a dog to a stationary object for a period of time or in a location so as to create an unhealthy situation for the animal or a potentially dangerous situation for a pedestrian as determined by the animal control officer."

 A dangerous animal is among other things defined as. . . "or dangerous animal or an animal that has exhibited characteristics of lunging, snarling or baring its teeth in a threatening manner at a person or another animal indicating said animal will make an unprovoked attack on a person or another animal or bite a person or another animal if not restrained." 

And deadly force can be used:  " Deadly force may be used against any animal presenting an imminent risk of death or serious bodily injury. Usage of nondeadly force methods to control an animal, such as apprehension or tranquilizing, shall not be required if such methods would add to or prolong the risk of death or serious bodily injury to persons."

In a nutshell, from my vantage point, if this had been my dog, considering our ordinances, there are enough regulations that would have protected the LEO regardless of what one personally thinks about it.  Nowhere in our ordinance, does it say that Animal Control has to prove anything.

animules,  FYI...  I did find it and read it however had not even known what it was about until it was mentioned here,  have been a bit preoccupied with my own problems here, and only following a couple of threads here,  don't have all day to bash away like some do !!   And just so you know I am not touching that thread with a 10 foot pole,  Anything I would try to say would be twisted and gutted anyway so what is the point ??

EM, I don't see how saying you wish both a full recovery would be considered bashing.  But hey you have your own problems like bashing over Max so don't be concerned.

the "Problems" I was reffering to,   How Quickly you forget,  I do have a lost dog I've been searching for,  Oh ya but that annoyed you too. 

How did we get so OFF topic on this thread oh ya that was YOUR buddy who brought it up hhh??   Of course NO MOTIVE THERE either right ???   No Agenda from YOU guys,   What was I thinking !!!!   Nice Try,  Keep covering your tracks but you may want to get a new branch the leves on the one you have are falling off and your leaving a VERY CLEAN track !!
