If the guy spent $500.00 at the vet for a puppy he just bought I don't think it means that he is a bad home.  I have no idea what you charge for your pups and I don't really need to know but if I had that kind of a vet bill immediate.....

Chalk it up to experience.  Lesson learned and move on.

NOT a felony or even a crime in Oregon !!!   to stop payment on a check....

check your facts LOVETHYSHEP before you go spewing like that....I make no claims against you here,  I still feel you WERE LESS THAN FORTHCOMING regarding Yako's purchase and ORIGIN of REGISTRATION,  but I make no Claim that you are  LIAR !!!!

Betty,  my atty suggested it would cost more to fight than it's worth,  and the guys atty, wants to settle out of court,  like you said lesson learned,  move on,  once again I get F**ked in the A** with NO vaseline please.... ROFL  OMG  this is such fun,  NOT.

love thy shepherd,

i do not agree. i bought a dog for 5000 dollars with a check. i did this on a saturday afternoon. the woman had no problem in doing so. i got to take my dog home with me the same day.

e.m.

if i were you, i would go and take the dog back and tell them to prove it was their dog in the first place. do it when they are not home. and if you feel bad about it, replace the dog with a kitten.

Does the guy live in Oregon as well?  Does it stipulate in your contract any legal precedings will take part in your county/state?  If so, take him to small claims court, I bet just the threat will cause him to give you your money.  You don't deal with lawyers in small claims court (think Judge Judy) so you won't have to worry about that expense...

by EchoMeadows on 29 November 2007 - 08:11

to answer animules,  NO you can't file a police report,  I tried !!   They said it's a "Civil" matter.

VBK9  that is exactly where this is headed if we can not get this resolved soon.   I already have the paperwork to file a small claim filled out.

EM,  have you and your attorney bothered to read your contract? There is a clear mechanism in there that allows you to take back this dog - but then again that wouldn't be the stuff of drama and victimhood would it?

Echo

Do you think there is a possibitlity that the buyer is the one that feels screwed?  That is a lot of money to spend at the vet for a pup you just took possession of.

As I said earlier my atty,  advised that it would be wayyy expensive to have her take this to court to fight the guy on it...

Look I was just trying to warn people about this,  and Yes I'm pissed as HELL that this JackASS has our pup !!  But short of spending several GRAND,  I will NEVER see this dog.   In small claims I stand a sliver of a chance of getting the pup back and a slightly better chance of collecting for it.

either way I just thought it might be nice to let others know about this....  I Did NOT know a person could OPENLY commit this TYPE of theft and our system call it LEGAL !!  or more aptly "Civil"

by Betty on 29 November 2007 - 17:11

I would think small claims would be a slam dunk unless he has a good counter claim against you.  In my opinion he would, several hundred dollars of vet bills on a brand  new pup.

I don't know what you states lemon laws is on dogs or your required health checks before selling a pup are, but I would be checking those very closely to make sure I had crossed all the t's and dotted all the i's.

And if it's only about the pup, take comfort that the pup is in a home where the owner would spend that kind of money within days of taking possession of the dog.

Really; let if go and be happy that he is not seeing an attorney about suing you.  Bottom line is you sold him a sick pup.

And pray that he never stumbles on this site and this thread.
