Echo, if you wait long enough the stop payment request will expire and the check will once again be good. Not sure how long you would have to wait, probably varies from state to state. If a stop payment were a crime, the banks would not allow it. If you could prove the party had no funds in the bank at the time of the stop payment, then you might have a case for fraud.

I agree with Betty, Amen !   You sold this guy a sick puppy !!    Find some other way EM to amuse your time cause we are waaay sick of all your crap.  It's amazing how you avoid the real issues, every time you post here.  It's not about getting your dog back, you sold him a SICK PUPPY.

 In Washington State, the buyer can get treble (triple) damages for having purchased a sick puppy and incurring a hefty vet bill.

Wisconsin will soon have a puppy lemon law as well. Hope it covers AKC papers. Never got papers for Murphy and when I called AKC for help they basically said tough you-know-what.

I wonder what Oregons lemon laws are.....  If the purchaser is from Washington and the seller is from Oregon, do the treble damages count?

Where did the sale take place?  If Oregon, Oregon law applies.  IF  Oregon has a Puppy Lemon law (and I  DO NOT KNOW whether it does or not ), the buyer may have some recourse there, too.  Hell, for that matter,  if the parties are in different states, given enough money/valued involved and internet involvment, it could evenarguably  go to federal court .   LOL

Since the Original Poster also posted the same info on their website wouldn't that really strengthen  the possibility of Federal Court?  Aren't there some new internet laws that hold people a wee bit more accountable for what they  post?

I checked the site yesterday, was curious to see how much the pups were being sold for and if he had exceeded the puppy price in vet bills.

The purchase price was originally 1,000.00 However I had them write the check for only $980.00 as my dog food order had not come in (was supposed to have been there that friday did not come until following monday or tuesday) and I did not want to risk running out of Puppy food was down to 4 bags so gave them plenty to last a week or so and reduced the fee by $20.00 to help offset the cost as they were to receive a free bag of Solid Gold puppy food.

The vet bills HE CLAIMED to be $725.00 over the phone to me,  that is when I offered to pay 350.00 of it,  Then I get the ACTUAL bill it's only 459.00  when I questioned him about the difference he said "I got the vet to reduce it"   funny,  every time my vet gives me a discount on something they NOTE it on the bill as such so that at the end of the year they can denote all of the "discounts" for tax purposes,  This poor vet must be loosing 1000's per year by NOT denoting such discounts....

The PUP had to be TRANQUILIZED,  NEVER was given IV fluids,  was given sub Q fluids,  had one day off feed, with some mild vomiting and diarhea,  the next day she ate, and HELD the food down,  I was in contact with the vet every day getting updates on her...  Even HIS OWN vet felt the posative test was due to the vaccine 4 days previous,  and felt her getting ill was just due to the stress of such a long travel,  some pups travel better than others,  We have NEVER had a bad health check previous to this.

I upon his reporting to me that the pup was ill,  ASKED him to bring her back and I would give him his check back or replace the pup whichever he would choose....  I offered to pay his entire vet bill and give him his check back for the return of the dog after the dog was released from the vet on day 2....  I offered to less the bill from the purchase price in exchange for a spay contract.....  He refused all of the above....... YOU TELL ME What the hell would you guys have done differently ????    WHAT the HELL did I do wrong other than NOT choose wisely in a buyer !!!

I wouldn't go whining & crying on a message board.  You say you just want to warn people that putting a stop payment on a check does not constitute theft.  Bullshit !!! If that were the case you wouldn't have continued to complain plus then post the whole sordid details.  You do this every time you think someone has "wronged" you in your GSD business.  This isn't the place for it.  I have never heard so much damn drama in my life.  You know, you are not the first GSD breeder not to collect on puppies or the first GSD breeder to SCREW UP when purchasing a male, but somehow you always blame others for your own mistakes.   The pup was sick, the guy paid the vet bill & now doesn't want to pay for the pup.  Go to court or forget about it, either way get real.
