Hello,

I was just wondering if anyone could give me some advice. I was recently going to buy a GSD pup from a breeder. I had put down a $200 deposit almost a year ago this spring.

First thing that happened was she decided to change the dam, the dam she was going to breed wouldn't be coming into season into the fall...I was ok with that wait though a little disappointed. I had told her I wanted a male red and black long coat (I know I know...its a breed fault...but I am just looking for a companion animal). Anyways the one red and black male ended up dying at about 2 weeks of age. She then offered me a sable long coat male at 7 weeks. I told her I would wait until her next spring litter as I wanted a red and black pup. Then the next litter the mom ends up having a false pregnancy. No puppies until later this summer now.

I decide maybe it's a sign to move on and adopt a dog from a humane society or rescue group.

So I e-mail the breeder and ask for the deposit back because I have decided not to wait until the next litter. It stats on her website that if she can't supply you with the coat/colouring of a puppy from the litter you put money down for she will give you back your money...though if she can supply you with a pup and say the timing doesn't work for you then she will keep the money as a deposit for another litter.

She replied to me and said that since she was able to provide me with the sable long coat from the first litter and I turned it down she wasn't going to give me back my deposit.

Any advice would be much appreciated! Thanks.

I put more money in my gas tank in 2 weeks.

if all this is verbal and mutual then you may have a hard time getting the money back. Verbal agreements work where there is some level of personal relationship.

Take her to small claims court.  Your best option. But it could take awhile!

Most breeders state quite clearly that deposits are non refundable. What did you receieve from her when you gave your deposit? Every breeder I've dealt with puts that in writing.

has the world gone mad!!!

try asking her again and state your intentions to get a rescue.

but she has already offered you a pup and you turned it down breeders dont have x ray eyes!

wait untill her next litter or as i said cut your losses

What is small claims going to get you? 

Take a day off of work to possibly get some of your money and pay court fees?

It's $200, not $2000.

Look at it as a $200 lesson in life.  Speeding tickets can cost more than that.

If it's not that much money, then why doesn't the breeder return it?
