Am I getting this right? Some guy is using the name/fame of a stud dog he does not currently own but does have 1 litter sired by to lure potential puppy buyers in to making non-refundable deposits and or puppy sales not from that litter?
If I'm on track, then yeah he sounds like an untrustworthy individual. With that said uninformed buyers make a$$ hat breeders rich all day everyday. If this stud dog is so desirable/valuable for what ever reason a little bit of investigating will reveal who really has possession of the dog.
Just my 2 cents and trust me that's all my opinion is worth these days.... LOL

It often comes down to a dispute between breeders and whose ox is being gored. Because this person does not have physical possession of the stud does NOT mean that he/she won't have additional litters from him. Ever heard of COLLECTING, or AI? 
I know of a mass-breeder/importer who seems to routinely breed to imported males, even while advertising them for sale. There is nothing to prevent collecting them for future breedings and owning the semen.
So, the breeder in question "could" have additional litters from that male. Certainly, a little forgery, if need be, wouldn't be beyond the pale...

Sounds like the seller is stupid and lazy for handing over a dog before it was paid for.
Sounds like the op is making a lot of accusations and assumptions (witch hunt anyone?). I don't know how you can jump to the conclusion that the breeder is dishonestly collecting deposits just because the breeder has a future litter still being advertised on their web page (a litter that was going to be a future litter but is no longer possible). Doesn't seem too farfetched that the breeder forgot it was up.

If it were, I could have easily already exposed this person and I have not done so.
Even though IMO he is deserving of this.
Suffice it to say I know said purchaser of stud dog did not own this stud, and papers were never issued in his name..
Ownership of dog was not to happen until dog was fully paid for...
but.. no payment was ever received...at all.
SO yes, he could have collected this dog till the cows come home, he may even have done so, but that doesn't mean he can use the semen.
Well...I guess he can even USE the semen, but he wont be getting litters registered from the pups that he is advertising his future litters from.
My reason for this post was to get input from others on their view of this being done by someone, and who, if having been faced with this same scenario, may have effectively dealt themselves with a person doing this.
Do you see this as fraud?
Do you see this as a bait and switch so as to get and keep a non-refundable deposit.. ?
Even if this doesn't affect "your own back yard"...
what would you do to prevent others from being scammed, if you knew this was the situation?

Doesn't really concern me, as I don't pay nonrefundable deposits for dogs that are not yet born.

I would contact the local district attorneys office and file a consumer complaint.
