Any chance they already had a GSD with bad hips? They bought yours, had the other put down sent the reciepts to saying it was your dog??? Not hard to switch them if it's a new vet that doesn't know them or the dogs. Maybe they just want a free dog to replace the other.

OK time for an update.

I have spoken to our Local specialist reader, who was shocked that these people euthanized this puppy without further thought.

I also sent an email to them re my conversation which they answered by asking this readers phone no, which I was more than happy to supply and give references so I was quite confident that they would ring him ( I will check with him on Monday to find out if he has spoken to them).

* Today they have said via email that on legal advise they will not to send the xrays for another opinion as they already have 2 opinions.

So Please cough up or see me in court. *

I need legal advise now or settle up ----

If it goes to court then they would have to have a qualified reader (not just any vet ) to give an opinion RIGHT ?? And really that is all I want, I need to know if I have created a problem with this mating both male and female of course do have excellent hips and elbows, (all other puppies from the litter are fine).

I wouldn't give them a cent, and if I had the means I would hire a lawyer.  The vet clinic sounds unscrupulous.  I would be livid!!!!  Just reading this makes me angry.

I doubt they have any intention of taking this to court, they are just trying to scare you into paying. Do not pay them anything. Even the idea of you paying them back the money for a dog which they then wrongly killed is just beyond words.

Did you have a contract that they signed saying if there was any problem that the pup should come back to you? If so I would tell them that I was going to counter sue them for breach of contract.

Even if they did take you to court I don't think you have anything to worry about, you did everything right, they did everything wrong. It would be plain as day in a court!

You are in Australia I believe, correct??  If so, few of us in the US would know what animal laws are in effect in your area.  Here we have "Puppy Lemon Laws" that can vary significantly by state.  Some have a deadline that the buyer must act within 2 weeks, or 6 months, or even up to a year.  If the dog is found sick, or has a genetic defect, based on the state, the buyer can get a replacement, a refund of the purchase price, and/or all their medical bills covered, etc.  In most the dog would need to be returned.  Also, some small hobby breeders are exempt from PLLs altogether.

I would do a search online for something similar partaining to where you live, if things are not written in a contract or stated clearly on your website.  If they took you to court I do not know that they would need a specialists opinion as they have 2 vets and for the average Joe they would think those are experts :(  But so much depends on the judge, and any lawyers either side bring with them.  Because I am assuming you do not have a contract, then it would probably just be "the breeder told me a full refund and vet bills for anything wrong" and that is usually not enough, BUT you as the "professional" are less likely to be looked at as the victim.  Generally the judge will want things in black and white and not care about their "sad story" so you have that going for you.

IMPO I would call their bluff (unless you find you are obligated to something by your PLLs) and try to put it behind you unless you get served... then I would get a lawyer or at least consult with one (some will give you free help over the phone).  In this, I have to feel for them too as most likely their decision was out of ignorance and trusting the wrong source (the vet).  It sounds crazy that she was a great addition to their family and they had her spayed only to be put down on the same day... unless something fishy is going on, it "sounds" like the vet made them feel her hips were terrible and she is and would be suffering.  They were too quick to agree, and went about it completely wrong and THEY have to live with it, BUT you can tell them that you support them if they choose to take the vet to court and NOT you.  The vet likely has insurance for this sort of thing, and if they are just looking for their money back then that is probably the way to go.  It would be nice to stick it to this vet too, from all we've been told about this situation ;)

I am not a breeder and only a dog owner but just hearing about this situation, and the way the poor pup was PTS, just makes my blood boil.  Do not pay a cent to those creatures who never gave the girl a chance. 

I suspect the real culprit in this, is the Vet (who probably made a mistake somewhere during the spaying and wanted to "remove the evidence") and the buyer simply went ahead with their advice to PTS.

My God, been away and come back to read this and more on poor Al...WTF is wrong with people?!!!  This is why I have only males (except for my spayed rescue) because I cannot fathom  dealing with the public and going through this heartache.

Suggestion from the lawyer in me, if you give any health warranty or your state requires it, get the buyer to sign (in addition to the contract) a limited power of attorney or other form of permission giving you (seller) the power to access and obtain copies of all medical information, including X-rays and lab reports on the dog.  For the hell of it, I'd also put something in there for liquid damages if they put the put to sleep or rehome it without giving you (seller) the option to have the puppy returned to you for the original purchase price. make sure the liquid damage clause is about 3 x the purchase price.

Dogshome9 - you say you provide a puppy pack? Is this a written document? If so, what you have written about returning the pup to you is enough to counter sue for breach of contract.
Furthermore, there is a different name in the x-ray, so you of course will need a specialist's opinion on YOUR pup's hips, not another dog's hips.
There are many ways in which this can be shown to be completely the purchaser's or their vet's fault and it should never have happened.

I know it won't help Ricci now, but for future reference, maybe it's worth ensuring that you are a joint owner on the paperwork for at least 12 months after someone takes possession of a pup. You can reiterate and back up all other contractual areas in writing also; preventing ANY treatment without your say so.
Then when you sell a pup you find out which vet he/she is registered with and contact them in writing to let them know that they MUST inform you before any treatment is carried out.

Good luck with whatever you decide to do ultimately. I hope these people get nothing in Court and are prevented from owning other dogs.

Great news, but otherwise extremely sad for my puppy!!

I have an independant review of the xray photograph and have been told that had this puppy's hip xray had been submitted for a review then they would have past our hip scheme, even at only 8 months old her hips were normal.

Now I need to take this info and decide what to do next.

Justice for my puppy ???????

this is such a load of cr@p....
are they freaking serious!!!!

my dogs x rays (prior to FHO) were posted on page 2...Bailey (black background) and they are far worse than the dog that was PTS....there are other options such as surgeries  IF NEEDED which i don't think this dog even needed a surgery....

I cannot believe it...tell those people that if anything happens to them and their kids are up for foster care you will be the first one to volunteer....and to make sure that they have a quality life since they suffered long enough in their present cruel and cold hearted house hold...

I would sue them for the wrongful termination of life, breach of contract...call animal rights organization see if they can give you a good attorney a lot of them have better contacts than you would ever dream of...and I am sure news paper are always looking for something juicy...so why not make sure that these people would never own another dog again...i would...
