I would have returned the deposit immediately when I obviously could not provide the puppy (and yes, the color, coat and sex) the buyer had wanted from the start - after all, the buyer never changed his mind, backed out or refused a puppy that met his criteria - the puppy was not produced!  Simple as that.  Written on the website, contract or not, deposits should be non-refundable only if the puppy IS produced and the buyer changes his mind, doesn't pay for the pup, returns the pup for some reason other than health, temperament, working ability etc, or backs out.  If the puppy is not available for any reason (including if the breeder changes his mind about selling the pup to the buyer) then the deposit FOR THAT PUPPY should be refunded.  No other option, for me.  However, unfortunately it IS, in the end, up to the breeder to refund the deposit or not.  Best thing to do is talk with the breeder, don't threaten or spread it over the internet.

No twisting of words, the breeder said she would continue to breed her a colour Dog she wanted.

but the one who wanted it did not have patience to wait, and as for making my life misarable, i do not think so, remember i was being hunted ,but turning to Hunter and i never give up until i accomplish what i set out to do

Your bringing up stupid phases of hunting people down is what bought this on

Reading Mollys post above, I see her reasons and herself being a breeder knows the right and wrong way , and iI bow down to her Posting and retract my former first posting

When I was breeding, I asked for a deposit of $100.00, we weren't getting much more than $500 for puppies in those days. I gave a written receipt that stated the total cost of the pup, the amount of the deposit, the total due  (in cash) when the puppy was picked up at 8 weeks or older. Also, the sire, the dam, their AKC numbers and DOB's, the approximate date the litter was expected. The desired sex if any, the color preference if any, show or companion quality and a blank space for "other". I also stated that. "In the event the Breeder cannot provide the Buyer with the herein described puppy,  the Breeder will return the deposit in full to the Buyer or the Buyer may opt to let the deposit stand for a puppy from another litter. Buyer's option. Should the Buyer change his or her mind and purchase a puppy from another breeder or decide to not purchase a puppy at all, the deposit will be retained by the Breeder."

I never had to make good on this. I  felt it was the right thing to do and is what I myself would expect from a breeder. BTW, I didn't take that deposit until I was sure the bitch was actually pregnant.

Thats seems a fair enough deal  for anyone,   As i said above i was wrong in my way of thinking.

But as i will never breed with Dogs i guess it will never apply anyway

The Sport aspect is enough for me

Ulli:  I agree with you completely.  The buyer has been more than patient.  The breeder needs to hold up their end of the bargain and return the deposit they clearly represent as  REFUNDABLE.

Steve, you are better off that way I think. I never really cared for breeding dogs, got many of them back for various reasons, not one due to a valid problem with the dog, always something personal. It drove me nuts!! I finally understood that qualifying buyers wasn't my strong suit. Now when I want a dog, I buy one and leave the breeding end to the experts

Steve,

as I really enjoy seeing that you can reason with the thoughts brought up by Molly & Blitzen, I have the feeling that I should explain a little further. Please forgive me, my english is not as good as I wish it should be.

Basicly, what Blitzen & Molly are saying is not that far off from what I am saying. But this is not what I want to explain. It was not me starting these silly phrases, if I recall it right it was you : "I would not give her money back, even if I was orderd by court to do so....." This is what got me, and made me respond the way I did. In no way, it was my intension to attack you personally. In regards to the "hunting" issue, oh well, I may be guilty of using phrases, I hereby apologize.

What I will ad is, and I did this one time to a guy who owed me a considerably amount of money. I did recieve a court title, which is good to follow through for 30 years. I did followed it through over 7 years, having him checked out by a lawyer every year. He had to lay open all his income, and the income was over a certain amount, he had to pay towards me. And yes, his life became not very pleasant, because he knew I would not give up. This is what I meant by "hunting someone down" ! All completly legal, and I admit, also a headache for me, but I am just not willing to flush my money down the drain, or to allow someone to fool around with me.

Believe me Steve, I also, as any given breeder, had my fair share of experiences with customers. Some of them are excellent, some even became close friends to me. Also had the other sort as well, demanding & unreasonable. Still, I always try to keep my cool, and foremost, I will honor my promises.

Again, please forgive me if you had the expression that I was trying to bully you. This is not my way at all, and I am sure some peopel here will assure you of this as well.

Hi Ulli, doing great, thanks for asking. Any you? How are the puppies looking? You tell me when and where and I'll be there. Be sure to bring along some photos of your dogs so we can admire them together.

Nothing wrong or immoral about getting what you pay for. I've had to do it 3 times in my life. Ironically the one that proved the most difficult was the smallest sum - the $100 deposit  for the roof replacement mentioned above. Finally the PA Bureau of Consumer Protection got really nasty with him and I had my check in the mail in 3 days. Before that he promised to send it and never did. BTW there was nothing in writing other than his handwritten receipt for the deposit.
